Terms of Service

1. Acceptance of Terms

By accessing or using EUAuditPack ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

"We," "our," or "us" refers to Monk Technologies, which operates EUAuditPack. "You" or "your" refers to the individual or entity using the Service.

2. Description of Service

EUAuditPack is a documentation generation platform that helps businesses create compliance-related documents including:

• External-facing notices and the public Subprocessor List
• Customer-facing due diligence documents such as the Customer DPA and TOMs Summary
• Internal documents such as Vendor Registers, RoPA, retention, DSR, incident, DPIA, and checklists

The exact pack inventory may change over time. At the time of this version, the product supports 12 documents across public, customer-facing, and internal workflows.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

4. Subscription and Payment

4.1 Free Tier

The free tier includes limited features as described on our pricing page. Free accounts may include watermarks on generated documents.

4.2 Paid Plans

Paid subscriptions are billed through Wise. By subscribing, you authorize us to charge your payment method for the applicable fees.

• Pro Monthly: $29 per month
• Pro Annual: $249 per year (28% savings)

4.3 Refunds

Due to the nature of digital services, we generally do not offer refunds. However, if you experience significant issues, contact us within 7 days of purchase and we will review your case.

5. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Reverse engineer or decompile any part of the Service
• Resell or redistribute the Service without authorization
• Use automated systems to access the Service in ways not permitted by our robots.txt or that impair the Service
• Submit false or misleading information
• Impersonate another person or entity

6. Intellectual Property

6.1 Our Content

The Service, including its design, templates, code, and branding, is owned by EUAuditPack and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary content.

6.2 Your Content

You retain ownership of the information you input into the Service. You grant us a limited license to process your content solely to provide the Service.

6.3 Generated Documents

Documents generated through the Service are for your use. You may use, modify, and distribute them for your business purposes. The underlying templates remain our intellectual property.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability or fitness for a particular purpose
• Accuracy or completeness of generated documents
• Compliance with any specific law or regulation
• Uninterrupted or error-free operation

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EUAUDITPACK SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Legal consequences arising from use of generated documents
• Regulatory fines or penalties

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless EUAuditPack, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Termination

We may suspend or terminate your access to the Service at any time for:

• Violation of these Terms
• Non-payment of fees
• Fraudulent or illegal activity
• Extended periods of inactivity

You may cancel your account at any time through the settings page. Upon termination, your access to the Service will end, but these Terms will survive as applicable.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of Bangalore, Karnataka, India.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
